Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AptivHires ("AptivHires," "we," "us," or "our"), governing your access to and use of the AptivHires website at https://aptivhires.com and the AptivHires mobile application (collectively, the "Service").

By registering for an account, clicking "I agree," or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Services

AptivHires provides an AI-powered career acceleration platform that includes the following features:

• Resume Builder & Tailoring: Upload your resume or build one from scratch. Our AI tailors your resume to specific job descriptions.
• AptivBrain — AI Mock Interviews: Practice job interviews with our AI interviewer. Requires either an active Pro subscription or AptivCoins.
• Portfolio Generator: Create a shareable, professional portfolio page linked to your resume and projects.
• AptivCoins System: A virtual credit system that unlocks premium in-app features. See Section 4 for details.
• Pro Subscription: Unlimited access to AptivBrain AI interviews and other premium features. See Section 5 for details.

Some features of the Service are available for free. Others require AptivCoins or an active Pro subscription. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To access most features of the Service, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration and keep it updated.
• Maintain the security of your password and accept responsibility for all activity that occurs under your account.
• Notify us immediately at info@aptivhires.com if you suspect any unauthorized access to your account.
• Not share your account credentials with any other person or allow others to use your account.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are associated with fraudulent activity.

4. AptivCoins — Virtual Currency

4.1 What Are AptivCoins?

AptivCoins are virtual credits used to unlock premium features within the AptivHires platform, primarily AptivBrain AI mock interview sessions. Each AptivBrain session costs 10 AptivCoins. AptivCoins are stored in your account and are visible on your dashboard.

4.2 Ways to Earn AptivCoins (Free)

4.3 Purchasing AptivCoins

You may purchase AptivCoins through the AptivHires platform using the following packages:

All purchases are processed securely through Stripe. By purchasing AptivCoins, you agree that:

• AptivCoins are non-refundable once purchased (except where required by applicable law).
• AptivCoins have no expiration date while your account remains active.
• AptivCoins are non-transferable — they cannot be moved between accounts or converted to cash.
• AptivCoins will be forfeited if your account is terminated for violating these Terms.

4.4 Using AptivCoins

AptivCoins are deducted automatically when you start an AptivBrain mock interview session. One session costs 10 AptivCoins. Coins are deducted at session start. If a session is interrupted due to a platform error on our side, please contact info@aptivhires.com and we will review and restore coins at our discretion.

Users with an active Pro subscription do not consume AptivCoins for AptivBrain sessions — they have unlimited access while their subscription is active.

5. Pro Subscription Plan

5.1 What's Included

• Unlimited AptivBrain sessions — No coin deductions while your subscription is active.
• Priority access to new features and improvements.
• Premium account badge and dashboard indicators.

5.2 Billing Cycle & Auto-Renewal

Your Pro subscription is billed on a monthly recurring basis, starting on the date you first subscribe. Subscriptions automatically renew each month unless you cancel before the renewal date. You will be charged the then-current subscription price before each renewal. We will notify you of any pricing changes at least 30 days in advance.

5.3 Free Trial

If a free trial is offered at the time of your subscription, no charge will be made during the trial period. After the trial period ends, your payment method will be charged unless you cancel before the trial ends. Trial terms and duration will be clearly disclosed at the time of sign-up.

6. Billing & Payments

6.1 Payment Processor — Stripe

All payments on AptivHires are processed securely by Stripe, a leading global payment processor certified to PCI DSS Level 1 — the highest level of payment security certification. AptivHires does not store your credit card number, CVV, or full payment details on our servers. This data is handled entirely by Stripe.

By making a payment, you also agree to Stripe's Consumer Terms.

6.2 Accepted Payment Methods

We accept all major credit and debit cards (Visa, Mastercard, American Express, Discover) and any other payment methods supported by Stripe in your region.

6.3 Failed Payments

If your payment fails (e.g., declined card or expired payment method), your Pro subscription may be suspended or downgraded to the free tier. We will attempt to notify you via the email address on file. You can update your payment method from your account's subscription management page or the Stripe billing portal.

6.4 Taxes

All prices are listed in USD. You are responsible for any applicable taxes in your jurisdiction. Stripe may collect applicable taxes on our behalf where required by law.

7. Cancellation Policy

7.1 How to Cancel

1. Log in to your AptivHires account.
2. Go to your Profile page.
3. In the Subscription Management section, click "Manage / Cancel Subscription."
4. You will be redirected to the Stripe Customer Portal where you can cancel your subscription.
5. Once cancelled, you will receive a confirmation email from Stripe.

7.2 What Happens After Cancellation

• Your Pro access remains active until the end of your current paid billing period.
• After the billing period ends, your account reverts to the free tier.
• Your AptivCoins balance (from prior purchases or earnings) is retained — they are not deleted.
• You will not be charged again unless you re-subscribe.
• Your resume, portfolio, and other saved data are preserved.

7.3 Account Deletion

If you wish to delete your account entirely, please contact us at info@aptivhires.com. We will cancel any active subscription, delete your account, and permanently remove your data from our systems within 30 days. Note that account deletion is irreversible — all your resumes, portfolio data, and AptivCoins will be permanently deleted.

8. Refund Policy

8.1 AptivCoin Purchases

AptivCoin packs (Quick Prep and Power Hour) are non-refundable once purchased and credited to your account. This is consistent with how other virtual currency systems work (similar to tokens, credits, and coins in other platforms). Please make sure you want to purchase before completing the transaction.

8.2 Pro Subscription

We do not offer prorated refunds for unused time in a subscription period if you cancel mid-cycle. When you cancel, your Pro access continues until the end of the paid period — you are not losing the service you paid for. We recommend cancelling before your next renewal date to avoid being charged for the following month.

8.3 Exceptional Circumstances

If you believe you were charged in error, or experienced a significant technical failure on our platform that prevented you from accessing the service during your paid period, please contact us within 7 days of the charge at info@aptivhires.com. We review each case individually and will issue a refund at our discretion if the issue was caused by us.

Nothing in this policy affects your statutory rights under applicable consumer law in your jurisdiction.

9. Data Security & Privacy

10. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Attempt to reverse-engineer, hack, or gain unauthorized access to any part of our systems.
• Use automated bots or scripts to scrape, crawl, or abuse the Service.
• Upload malicious content, viruses, or harmful scripts.
• Create multiple accounts to abuse free trial offers, referral bonuses, or coin rewards.
• Misrepresent your identity or impersonate any other person.
• Use the AI features to generate fraudulent, harmful, misleading, or illegal content.

We reserve the right to suspend or permanently terminate accounts that violate this policy without notice or refund.

11. Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind. AptivHires does not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.

To the fullest extent permitted by law, AptivHires shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of revenue, loss of business opportunity, or damages arising from your use of or inability to use the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to AptivHires in the 3 months prior to the event giving rise to the claim, or (b) $10 USD.

AptivHires AI-generated content (including mock interview questions and feedback) is for practice purposes only and does not constitute professional career, legal, or financial advice.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and may notify you by email or in-app notification. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in the United States.
